These Terms and Conditions govern your use of YourJobFinder.com (the "Company Site") and your relationship with Marketing Punch Ltd, (the "Company", "we" or "us"). Please read them carefully. They affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Company Site.

1 Use of the Company Site

1.1 The Company Site is for your personal use. It is subject to these Terms and Conditions. By using the OffersX site, you are agreeing to be bound by these Terms and Conditions and by our Privacy Policy. To view our Privacy Policy, click here.

2 Updates

2.1 We may update these Terms and Conditions at any time for legal or regulatory reasons or to allow the proper running of the Company Site. You will be made aware of any changes made by announcements posted on the company website. After we have given notice, the changes will apply to the use of the Company Site. Do not use the company site if you do not accept the new Terms and Conditions. Your use of the Company Site, after the date that any changes come into effect, indicates your agreement to be bound by the new Terms and Conditions.

3 Services Provided

3.1 Our services include: i) online advertising of third parties' products and services and ii) an online recruitment and employment information service, that allows recruiters to place listings for positions which they have available. If you become interested in any of these positions, you may submit an application and your CV to apply for them (the "Services").

3.2 Any dealings with recruiters and/or third parties will happen directly between you and them. Any contracts and/or arrangements will be formed between you and them, and not with us. This means that we cannot be held liable for your use of our services or for the contents of CVs and advertisements (save to the extent required by law).

3.3 We will not be a party to any communications made whatsoever between you and anyone that you may deal with in relation to the Services. However, we do reserve the right to monitor any communications which are made by you or by any third parties through the Company Site and/or the Services.

3.4 The Services are only made available to you following your completion of the registration section on the Company Site. This includes a confirmation from you that these Terms and Conditions and our Privacy Policy have been read and accepted.

4 Registering

4.1 You must be over eighteen years of age to register on the Company Site.

4.2 You must be certain that the details you provide at registration or at any time are complete and correct.

4.3 You must immediately tell us of any changes to the information that you have provided upon registration. This must be done through updating your personal details, enabling us to communicate with you.

4.4 Your information is processed in accordance with our Privacy Policy. You consent to such processing and you warrant that all data provided by you is accurate by registering with us.

4.5 The password you create upon registration to the company site must kept confidential. You must not disclose it or share it with anyone.

4.6 Registering for the Services pursuant to clause 3.4, you automatically grant to us a royalty free right to display, copy, reproduce and make available on the Company Site and otherwise deal with as necessary to provide to you the Services any material and information which you may provide to us through your use of the Services.

5 Intellectual property

5.1 Content on the Company Site is protected by copyright, trademarks, database right and other intellectual property rights that belong to either the Company or to third parties. The Company Site’s content may be displayed on a computer screen, stored in an electronic form on a disk (but not any server or a storage device connected to a network) or printed as a single copy for your own personal and non-commercial use. This is provided you keep any copyright and proprietary notices intact. Apart from within these expressed parameters, you may not reproduce, copy, modify or distribute or use for commercial purposes any of the materials or content on the Company Site without prior written permission from the Company and/or any third parties.

6 How you use the Company Site

6.1 You may not use the Company Site for any of these purposes:

6.1.1 transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;

6.1.2 disseminating any harassing, unlawful, libelous, abusive, threatening, vulgar, harmful, obscene, or otherwise objectionable material or otherwise breaching any laws;

6.1.3 interfering with any other person's use or enjoyment of the Company Site; or

6.1.4 making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

6.2 You will be responsible for our costs and losses that result from your breach of this clause 6

7 Availability of the Company Site

7.1 We make no promise that the services available through the Company Site will meet your requirements. Due to this, we cannot guarantee that the services will be faultless.

7.2 The material on our site may be out of date at any given time, despite our attempts to update it as quickly as possible.

7.3 Your access to the Company Site may be occasionally restricted. This is simply to allow for repairs, maintenance or the creation and introduction of new facilities or services. We will always aim to restore the Company Site to full service as soon as is possible.

8 The Company's right to suspend or cancel your registration

8.1 We reserve the right to suspend or cancel your registration at any time. This can happen immediately. We also reserve the right to deny you access to the website and/or any of our services in our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

8.2 Inform us in writing at Contact@YourJobFinder.com.co.uk to cancel your registration at any time. You must then stop using the Company Site.

8.3 The suspension or cancellation of your registration and your right to use the Company Site shall not affect either party's statutory rights or liabilities.

9 The Company's liability

9.1 The material on the Company Site may not always be accurate. This means that such content is without any guarantees or conditions as to its accuracy. We and any other members of our group of companies and third parties connected to us hereby expressly exclude (to the extent permitted by law):

9.1.1 All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

9.1.2 Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

9.1.2.1 loss of business;

9.1.2.2 loss of income or revenue;

9.1.2.3 loss of business;

9.1.2.4 loss of profits or contracts;

9.1.2.5 loss of anticipated savings;

9.1.2.6 loss of data;

9.1.2.7 loss of goodwill;

9.1.2.8 wasted management or office time; and

9.1.2.9 for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above. However, this does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

9.2 If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you use the Company Site. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

10 Third Party Websites

10.1 The Company Site includes links to other web sites. It also includes material which may be outside its control. This is for the convenience of our users. The Company is not responsible for content on any site outside the Company Site which it may be linked to.

11 Advertising and Sponsorship

11.1 The Company Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Company Site complies with relevant laws and codes. As such, we will not be responsible to you for any error or inaccuracy in advertising and sponsorship material that can be found on the company site or on third party sites.

12 Transactions concluded through our site

12.1 Contracts for the supply of goods or services or information formed through our site or as a result of visits made by you are governed by the terms and conditions of third party web sites. These are outside our control.

12.2 As such, we do not accept liability for any loss or costs incurred through your use of third parties' products or services.

13 Viruses, hacking and other offences

13.1 You must not misuse the Company Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Company Site. This includes the server on which the Company Site is stored or any server, computer or database connected to the Company Site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

13.2 By breaching this provision, you will commit a criminal offence under the Computer Misuse Act 1990. Any such breach will be reported without hesitation to the relevant law enforcement authorities. We will not hesitate to co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Company Site will cease immediately.

13.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Company Site. This also includes your downloading of any material posted on it, or on any website linked to it.

14 Applicable Law

14.1 We will try to solve any disagreements quickly and efficiently and as such, these Terms and Conditions are subject to the laws of England and Wales. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so before the English courts.

15 International Use

15.1 We make no promise that materials on the Company Site are appropriate or available for use in locations outside the United Kingdom. Accessing the Company Site from territories where its contents are illegal or unlawful is also prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative. You alone are responsible for your own personal compliance with local laws.

16 Miscellaneous

16.1 Transference of your rights under these Terms and Conditions to any other person is prohibited. We may transfer our rights under these Terms and Conditions to another business. This business would be one where we reasonably believe your rights will not be affected.

16.2 If you breach these Terms and Conditions and the Company chooses to ignore this, the Company will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

16.3 The Company shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.

Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Company Site.

1 Use of the Company Site

1.1 The Company Site supplies to you a range of free services (the "Services"). These services are subject to these Terms and Conditions. 3.1 Our services include: i) online advertising of third parties' products and services and ii) an online recruitment and employment information service, through which you may place advertisements for positions that you have available (and use, print and download information from the Company Site for recruitment purposes) and, if interested, jobseekers may submit their CV(s) and application(s) for such positions (the "Services").

3.2 The Company has the right to provide the Services and will use all reasonable skill and care in making the Services available to you. This also includes ensuring its availability. However, the Company obtains its information for its services from a number of sources. This means that, due to the inherent risks involved in providing the Services through the internet, errors and omissions do occur from time to time. The Company does not give any other warranties in respect of the Services, including without limitation any warranty that the Services will be virus free.

3.3 Changes may be made to the site at any time. This is due to thre fact that The Company is continually seeking to improve the Services of the Company site. These changes can occur at any time and without any requirement for prior notice.

3.4 you will be responding to and dealing with jobseekers and/or third parties directly. As such, any contracts and/or arrangements will be formed between you and them. These contracts will not be formed with us. We accept no responsibility for your use of or any liability arising out of the same or for the contents of CVs and advertisements, save to the extent required by law.

3.5 We will not be a party to any communications whatsoever between you and anyone that you may deal in relation to the Services. However, although we reserve the right to monitor any communications which are made through the Company Site and/or the Services.

3.6 The Services will only be made available to you following your completion of the registration section of the Company Site. This will include confirmation from you that these Terms and Conditions and our Privacy Policy have been read and accepted.

3.7 You fully accept the functionality and design of the Services as amended from time to time by us. This includes the fact that we cannot guarantee a particular level of response to adverts or a minimum level of CVs available to you through our services on the Company Site.

4 Registration

4.1 To register on the Company Site you must:

4.1.1 Be certain that the details you have provided on registration or at any time are complete and correct;

4.1.2 You must immediately tell us of any changes to the information that you have provided upon registration. This must be done through updating your personal details, enabling us to communicate with you.

4.2 Your information is processed in accordance with our Privacy Policy. You consent to such processing and you warrant that all data provided by you is accurate by registering with us.

4.3 You will be asked to create a password when registering on the company site. You must keep this password confidential and must not disclose it or share it with anyone.

4.4 By registering to use the Services, you automatically grant to us a royalty free right to copy, display, reproduce and make available on the Company Site and otherwise deal with as necessary to provide to you the Services any material and information which you may provide to us through your use of the Services.

4.5 Your registration is an offer to use the Services made available by us for a specific period of time. This use is in accordance with these Terms and Conditions. You are free to accept or decline these at your absolute discretion.

5 Your Obligations and Responsibilities

5.1 Following any contact with jobseekers through the Company Site, you fully accept that:

5.1.1 It shall be your responsibility and the responsibility of any jobseekers you are in contact with to agree how to progress matters further;

5.1.2 You shall act at all times in good faith and in a business-like and courteous manner; and

5.1.3 You shall keep strictly confidential all confidential information disclosed by jobseekers. You shall also act in accordance with all requirements of the Data Protection Act 1988. You shall also act in accordance with the Employment Agencies Act 1973 (and all other relevant legislation and regulations made thereunder).

5.1.4 You shall not act in any way which may damage the Company Site's reputation.

5.2 By agreeing to these terms and conditions, you agree to comply with the rules set out below (hereafter known as the Company Rules) regarding the content and format of all jobs advertised on the Company Site. We may change these rules from time to time in our discretion and without any requirement for prior notice.

5.3 The Company Rules are as follows:

5.3.1 Any job advertisement is to be categorised accurately using an appropriate job category for each listing; and

5.3.2 There shall be no gratuitous use of keywords in job descriptions, job summaries, job titles or keywords fields. Gratuitous is defined as inserting words, strings of words or repeating job titles which influence the position of the results listings; and

5.3.3 Any job advertising which discriminates on grounds of sex, race, age or disability is illegal and may result in proceedings being taken against you. We do not permit discrimination in any sense.

5.3.4 If you do advertise a job with us, it must be currently available and their details verifiably accurate.

10 The Company's liability

10.1 The material displayed on the Company Site is provided without any guarantees, conditions or warranties as to its accuracy. we and any other members of our group of companies and third parties connected to us hereby expressly exclude to the extent permitted by law:

10.1.1 All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

10.3.3 Communicating updates to the job advertising screen service, including xml feed third party suppliers.

11 Third Party Websites

11.1 The Company Site includes links to other web sites or material which may be outside its control. Due to this, the Company is not responsible for content on any site outside the Company Site.

12.1 The Company Site may contain advertising and sponsorship. 16 Applicable Law

16.1 We will try to solve any disagreements quickly and efficiently and as such, these Terms and Conditions are subject to the laws of England and Wales. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so before the English courts.

17 International Use
